Unit Terms and Conditions

Scope of Application

1. These Terms and Conditions specify the content of an accommodation contract to be concluded by and between The Ferie and customer as well as the content of the services to be offered to the customer pursuant to the concluded accommodation contract. Note that any matter not provided for in these Terms and Conditions shall be governed by the provisions of relevant laws and regulations.

2. Any customer who uses The Ferie shall comply with the matters set forth in these Terms and Conditions.

3. When the The Ferie agrees with a customer in writing differently from these Terms and Conditions, notwithstanding the provisions of the preceding two paragraphs, the The Ferie and the customer shall follow the content as agreed.

Change to these Terms and Conditions

1. If either of the following items is applicable, the The Ferie may change these Terms and

Conditions:

A change to these Terms and Conditions conforms to the common interests of customers; or

A change to these Terms and conditions is not contrary to the purpose for which customers conclude contracts with The Ferie and is reasonable in light of necessity of the change, appropriateness of the content after changed, and other circumstances relating to the change.

2. When a change to these Terms and Conditions is effected pursuant to the preceding paragraph, customers shall be deemed to have agreed to the content after changed.

3. The change to these Terms and Conditions under paragraph 1 shall take effect as from the time of effectuation determined by The Ferie. However, in a case where changing of these Terms and Conditions as well as the content of the changed Terms and Conditions are not made known to customers, such change shall become effective as from the time when The Ferie makes it known to customers.

4. Making known to customers as is set forth in the preceding paragraph shall be made by the method of publishing the above content on The Ferie’s website.

Accommodation Application

1. A customer wishing to stay at The Ferie shall submit an accommodation application by the method specified by The Ferie.

2. In submitting an accommodation application set forth in the preceding paragraph (hereinafter, the “Application”), the customer shall provide to the The Ferie correct information on the matters listed in the following items:

(1) Name of a person submitting an application (Applicant) and his/her contact information;

(2) Number of those who are to stay in the The Ferie (Guests) and name of each of the Guests;

(3) Number of the guest rooms and their types (Specifications) the provision of which is desired, or a designed accommodation (package) according to an application;

(4) Date to check in (Start Date of Stay) and time to arrive at the The Ferie (Scheduled Arrival Time);

(5) Number of days to stay (Period of Stay);

(6) Name of the person who pays accommodation charge (Payer) and his/her contact information;

(7) Payment method for accommodation charge (including information on a credit card or debit card when paid by using such card, or information on a gift certificate when paid by using such certificate); and

(8) Apart from those set forth in the preceding seven items, matters specified by The Ferie.

3. A customer staying under the accommodation contract who wishes to stay in excess of the Period of Stay shall submit an accommodation application once again in accordance with the provisions of the preceding two paragraphs.

4. The provisions of the preceding three paragraphs shall not apply to the customers who collectively apply for accommodation for 10 rooms or more per day or for a total of 30 nights or more (hereinafter, “Group Customers”). In order for Group Customers to apply for accommodation, it is necessary to submit an accommodation application individually and separately.

Security Deposit / Additional Costs

If applicable to your reservation, the security deposit will be used at the sole discretion of The Ferie to pay for the restoration of the property to its original move-in condition (outside of other normal wear and tear). Additional costs include but are not limited to: cleaning beyond normal wear and tear, removing excessive garbage, repairing or replacing any part of the premises, its contents, common areas and recreational facilities for damage caused after your move-in. In the event that said deposit is insufficient, you agree to allow The Ferie to charge your credit card on file to pay the additional costs or we may send you an invoice that is payable in full upon receipt. If all terms and conditions of the agreement are fulfilled, the deposit will be returned in full within 21 business days after guest departure.

Repairs and Maintenance

We cannot guarantee against mechanical failure of heating, air conditioning, appliances or TV’s. Please report any inoperative equipment promptly and we will do our best to remedy the situation. Should a power outage occur beyond our control, please notify us and we will reach out to the power company to give you updates.

NO REFUNDS OR RENT REDUCTIONS WILL BE MADE DUE TO MECHANICAL FAILURES OR MALFUNCTIONS, INTERRUPTIONS OF UTILITIES, MAINTENANCE PROBLEMS OR CONSTRUCTION IN THE AREA. WHILE WE WILL MAKE EVERY EFFORT TO REPAIR ANY MAINTENANCE ISSUE IN A TIMELY MANNER, WE CANNOT GUARANTEE THAT THE ISSUE WILL BE FIXED DURING A GUEST STAY.

The Ferie will always look for alternative solutions to ensure and prioritize guest comfort.

Cancellations & Refunds

If the occupant cancels or otherwise terminates this Agreement at least 60 calendar days prior to the check-in date, guests may receive a 100% refund, minus a 10% processing fee.

If the occupant cancels or otherwise terminates this Agreement at least 30 calendar days prior to the check-in date, guests may receive a 50% refund, minus a 10% processing fee.

If the occupant cancels or otherwise terminates this Agreement less than 30 calendar days prior to the check-in date, guests will be charged 100% for all nights.

The Ferie reserves the right to change reservation accommodations or refund the full balance should the property become unavailable due to circumstances beyond its control. All reservations are non cancellable within 60 days of the scheduled check-in date. Weather related incidents and natural disasters beyond human control will be evaluated on a case by case basis and may be the exception to the rule.

Good Neighbor Policy

You agree to abide by all rules and regulations set forth by local ordinances, which includes a "Good Neighbor Policy". You are advised to keep in mind that vacation rental properties are located in quiet, private neighborhoods. Please respect our neighbors. Anyone found to be violating noise regulations, without prior approval, will be subject to an initial $500 fine followed by a possible eviction in egregious circumstances. Guests will not be given any refund for issues related to noise violations. Possible violations include, but are not limited to, limiting sound amplification outdoors, over occupying parking areas, over occupying rental property, failure to properly store trash, and having pets off leash. Quiet hours are strictly enforced between 10:00PM-8:00AM and no outdoor music or noise is permitted during those times.

There are no parties or events allowed at this property without prior written approval.

Pet Policy

Dogs under 55 lbs are allowed and are subject to a one time, $50 pet fee. You agree to abide by all of the rules set forth below including but not limited to;

Pet will not be allowed on furniture, or, in tubs and showers,

You will not use property bedding, towels, etc. to accommodate the pet,

You will not leave pet food outdoors, or in common areas on the property,

Pet will remain leashed outdoors, or in common areas on the property,

You agree to clean up after your pet both outside and inside, pet waste can be disposed by the dumpster located near the entrance of the property,

All pet(s) are current on vaccinations,

Only primary guests pet will be on property, any additional pet is subject to additional fees and must be agreed upon before check-in,

No pet(s) will be allowed on the property that has a history of property damage or harming people or other pet(s),

Guest confirms that pet(s) has no history of property damage or harming people or other pet(s),

Guests agree they will not leave their pet unattended indoors unless crated, or unattended outdoors. Guests will not allow pet to bark continuously outdoors or indoors with windows open, which disturbs neighbors and other guests. Guest agree to keep the pet with them while away from the cabin for long periods during the day or at night. The property is prone to wildlife that have been known to harm pets and it is unsafe for them to remain in property alone.

Guest assumes any and all liability for any damage pet causes, or harm pet causes to the property or person of others. Guest agrees to hold Owner harmless for any damage or injury their pet causes others. Owner recommends Guest obtain renter’s insurance that covers pets.

Approval of the pet is conditioned on Guest’s continued compliance with this policy.

Property Inspection

An inspection of the vacation rental property will take place 24 hours in advance of your arrival. If there are any concerns with the property upon your arrival, please notify The Ferie immediately to ensure that such issues may be remedied in a timely manner. The property will be subject to inspection upon reasonable notice to guests, which includes knocking on the door or ringing the doorbell before entry in the event that noise complaints are issued. The guest understands that this may occur anytime during the guest's stay if there is noise or reasonable suspicion of a party or any other violation of the house rules.

Occupancy Limits

Our rental rates are based upon a maximum of two persons per bed. Children are counted in total occupancy, unless they are under the age of 5 years old. Guests who violate the occupancy limits (i.e., having more than two persons per bed) are in violation and breach of these Terms & Conditions, and The Ferie reserves the right to deny access or to require all guests to vacate the premises. No refund of monies will be issued due to violation of the house rules, good neighbor policy, or occupancy limits.

Obligation to Follow Rules + Surveillance Our home is monitored by video electronic surveillance on the exterior of the house for guest security. Guest acknowledges that this Property is under 24-hour exterior surveillance and security monitoring and patrols.

No Event/Party Policy

Unless otherwise authorized in writing by The Ferie, no gatherings, loud celebrations, parties or other private events (collectively "events") are to be held at the vacation rental property during your occupancy. Holding an event without receiving prior approval, permit or permission from The Ferie is considered an abuse and breach of these Terms and Conditions and is cause for immediate termination of occupancy. Upon any infraction of rules, The Ferie may, at its sole option, terminate all agreements with you, including termination of occupancy immediately. In this event, you will forfeit all monies, including security deposits. Only those guests listed on the attached guest list to this rental agreement may occupy the property during the reservation periods.

Vacation Rental (Not a Lease)

This is a vacation rental agreement for temporary vacation stay at a managed vacation rental property. THIS AGREEMENT IS NOT A LEASE AND CONVEYS NO RIGHTS IN REAL PROPERTY. By agreeing to the Terms & Conditions, you stipulate and agree that you have not and will not receive a real property interest in or rights to the vacation rental property.

Liability and Obligation to Follow Rules By agreeing to the Terms & Conditions below, you waive, discharge and agree to hold harmless The Ferie and the real property owner from all damages or injuries arising from or related to your stay at the managed property, including but not limited to, any accidents or injury to yourself, your guests and associates, and loss of money, jewelry or valuables of any kind. You are responsible for keeping your valuables safe at all times. Guests agree to follow any and all House Rules provided to them. The guest will be held responsible for violation of any of these rules and hereby agrees to strictly abide by any and all rules thereof. The guest acknowledges that there may be periodic patrols and security monitoring to ensure that rules are followed.

Arizona Wildlife

Our property is located in the high desert and is inhabited by wildlife that you may not be familiar with included but not limited to;

Coyotes, Hawks, Eagles, Javelina, Tarantulas, Scorpions, Snakes, Rodents, Lizards, Spiders, etc.

It is against the law to kill or injure any of these wildlife, and anyone seen doing so will be subject to a $1000 fine.

If you should come in contact with any of these wildlife, leave them alone and contact The Ferie, or, The Yavapai County Sheriff’s Office Animal Control +1 (928) 634-7387.

The Ferie is not responsible for any wildlife that comes in contact or enters the property and home. By agreeing to our terms and conditions you waive, discharge and agree to hold harmless The Ferie and the real property owner from all damages or injuries arising from or related to your stay at the managed property, including but not limited to, any accidents or injury to yourself, your guests and associates.

Host Cancellation of Reservation

If the property which is the subject of this agreement becomes unavailable for any reason, all monies will be returned in full to the guest, with no further liability opposed upon The Ferie or the property owner, minus a transaction fee of 10% and applicable taxes. The Ferie will not be in breach of the terms of this agreement if the cancellation is beyond reasonable control including but not limited to a change in ownership of the property, a damage or malfunction of equipment, disturbances on nearby properties, construction in or adjacent to the property, governmental regulations or controls, fire or other casualties, technical failure or difficulties, problems or interruptions with the internet or television, computer viruses, acts of god, insurrections, terrorism, or any other cause.

Property Unavailable Disclosure

If, after this reservation is completed, and correspondence or discussions with the guest disclose a change in circumstances involving the reservation of this property, The Ferie has the right to refuse a reservation to the guest if the reservation is not conducive to the welfare of the property. Such circumstances include, but are not limited to, an event or party planned during the guest's occupancy of the property, violations of the occupancy limits, rules regarding pets, or necessary emergency housing for owner. This is not intended to be an all-inclusive list of circumstances which may cause a cancellation of reservation. If the reservation is canceled pursuant to this section, The Ferie will return all monies deposited to the guest, minus a 10% processing fee and applicable taxes.

Miscellaneous

Any and all legal matters arising out of this agreement shall be adjudicated in the city/county in which you are renting. Should any provision contained in any agreement between The Ferie or the Property Owner and you be held to be invalid, illegal or unenforceable by a court or other judicial tribunal of competent jurisdiction, the remainder of the agreement will be in full force and effect. You agree that any such invalid, illegal or unenforceable provision will be replaced with a valid, legal and enforceable provision that most closely accomplishes the former provisions' economic effect. You agree that electronic signatures shall have the same authority as original signatures and this agreement may be signed in any number of ways.

ALL GUESTS hereby acknowledge and agree to follow all house rules, neighborhood rules and city laws and ordinances.

The Ferie House Rules

Check-In: 4pm | Check-Out: 10am

  • Music and/or excessive noise outdoors (i.e., yelling, noise amplification, musical instruments, animal barking etc) must be kept to a respectful minimum at all times. Outdoor Music is not permitted after 11PM.

  • Neighborhood quiet hours are strictly enforced from 11pm - 8am.

  • No smoking allowed indoors. Smoking outside is permitted with the agreement that all ash and cigarettes will be disposed of in trash receptacles. Cigarettes littered on property will result in a $250 fine.

  • No open flames of any kind are permitted, including fire pits, candles and fireworks. We are in the high desert with extreme fire hazards.

  • No parties or events, lack of decorum and disruptive noise will not be tolerated; all events must be pre-approved in writing and terms and conditions followed.

  • Guest(s) must maintain all property and furnishings in good order; we have vintage and one-of-a-kind pieces on property; Guest(s) may only use appliances for their intended use; excessive damages to furnishings and decor will result in a $250 fine, or, the at cost replacement of the item(s).

  • Guest(s), other than those in the party provided, may not stay overnight in the property; All guests are the sole responsibility of the renter; Guests are not allowed to exceed the agreed upon occupancy limit;

  • All trash must be taken out and placed in the onsite dumpster.

  • Guests must use caution when using the common grounds; there are stairs without railings, and unsafe heights, use precaution when on property.
